How Oman gratuity is actually calculated
End-of-service gratuity in Oman comes from Article 61 of the Labour Law, enforced by the Ministry of Labour. Royal Decree 53/2023 changed the formula significantly, effective 31 July 2023 — and critically, the change wasn't retroactive. If you were already employed before that date and are still working now, your gratuity has to be calculated in two separate pieces:
- For service before 31 July 2023: the old tiered formula applies — 15 days' basic salary per year for your first 3 years, then 30 days' (a full month's) basic salary per year after that.
- For service from 31 July 2023 onward: the new formula applies — a flat one full month's basic salary for every year, no tiers at all.
Unlike Bahrain, which moved part of its system to a separate government-administered fund in 2024, both pieces here are still owed by the same employer, added together into one final settlement. There is a further reform coming — a 9%-of-salary savings scheme that will eventually replace this gratuity system entirely — but its rollout has been formally postponed twice and is now scheduled for 19 July 2027, so as of today, the dual-formula system above is what actually applies.
As with the other Gulf countries, this is based on your last basic salary only — allowances are excluded.
The full formula, step by step
Old formula — service before 31 July 2023

Prorating a partial year
Fractional years are prorated within whichever formula applies to that segment of your service, the same way as Saudi Arabia's calculation.
Resignation vs termination
Unlike Kuwait and Saudi Arabia, Oman's law doesn't reduce gratuity for voluntary resignation. Whether you resign, your contract expires, or you're terminated outside of summary-dismissal grounds, you're entitled to the full pro-rata amount under both formulas. The one exception is summary dismissal for serious misconduct under Article 41, which can result in zero entitlement — a specific legal scenario worth confirming directly with the Ministry of Labour rather than relying on any calculator.

Special cases the standard formula doesn't cover
Omani nationals
Omani nationals are generally covered by the Social Protection Fund's pension and social insurance system rather than this gratuity, which mainly applies to expatriate employees. Confirm your specific situation with the Ministry of Labour if you're a national.
Government and civil service employees
If you're employed directly by an Omani government body, your end-of-service terms follow separate civil service rules, not Article 61 of the Labour Law. This page doesn't apply to you.
The upcoming savings scheme
A future reform will eventually replace this entire gratuity system with a funded savings account (9% of basic salary contributed by the employer), similar in spirit to Bahrain's 2024 change. It's been postponed twice already — most recently to 19 July 2027 — so it isn't affecting anyone's entitlement yet, but it's worth watching if you plan to stay in Oman past that date.
What to actually do with your gratuity
If you're an Indian professional in Oman, your gratuity payout is often one of the largest single sums you'll receive during your time there — what you do with it in the weeks after matters more than most people plan for.
- Oman has no personal income tax, so your gratuity isn't taxed there. Whether you need to declare it in India depends on your residency status — worth checking with a tax advisor if the amount is significant.
- How you send it to India changes what you keep. Bank transfer, exchange houses, and remittance apps all quote different rates for the same amount — for a large one-off transfer, the gap between the best and worst option is often real money.
- If you're not spending it immediately, an NRE or FCNR deposit account is a common option for returning or long-staying NRIs to look into before parking it in a regular savings account.
